Workers' Compensation Benefits

For any work related injury, you qualify for workers' compensation benefits. State law obligates your employer to carry workers' comp insurance, if your employer has three or more employees. We will file a claim with the State Board of Workers' Compensation. Some of the benefits you may be eligible to receive include:

  • Income Benefits: You are eligible to receive up to $450.00 per week for an up to 400 weeks. Workers' compensation determines income benefits by averaging two-thirds of your weekly pay over the last thirteen weeks.
  • Medical Benefits: Your employer must provide you with medical benefits for reasonable treatment for work related injury. They also must compensate you for your mileage to your appointments.
  • Permanent Disability Benefits: If you suffer a life-long disabling injury, you may qualify for an extension of your workers' compensation benefits.
  • Cash Settlements: For many people, receiving a lump sum cash settlement in lieu of workers' compensation benefits is more appropriate.

Social Security Benefits

You may qualify for Social Security Disability (SSD) and Supplemental Security Income (SSI) in addition to workers' compensation. These federal income assistance programs supplement your income after you suffer a disabling injury. You can become eligible for Social Security in various ways, including if you are disabled, blind, at least 65 years old, with limited financial resources, are unable to work for at least one year, or suffer a recognized disability.
